Lecture given at the 3rd Congresso Nacional de Direito Digital (national digital law congress), at the OAB (Brazilian Bar Association) in São Paulo, on computer forensics and the production and preservation of digital evidence as proof. Adriano Vallim sets out the distinction between trace evidence, evidence and circumstantial indication, the volatility of data in memory, network and disk, and the use of write blockers, duplicators and dedicated tools for bit-by-bit forensic imaging, including data extraction from phones, drones and trackers. He also analyses concrete cases in which inadequate collection, such as a simple screenshot or handling by in-house IT teams, compromised court proceedings.
